| 1. | The Kowloon Motor Bus Company (1933) Limited (“KMB”) may from time to time amend and update these Terms of Use (the “Terms”) including but not limited to issuing additional terms for specific features of OPS1933 Mobile Application (the “Application”). Every user of the Application (“User”) is reminded to regularly review the Terms through the Application and be familiar with the latest version of the Terms. KMB may by means of posts in the Application, but shall in no event be obliged to, notify User of any update. By continuing to access or use the Application after those amendments and updates become effective, User agrees to be bound by the Terms as amended, which shall supersede all previous terms that KMB has with User. |

| 2. | The services and contents of the Application may from time to time be revised without prior notice to User. KMB may in the course of updating or upgrading need to suspend the provision of features of the Application without any prior notice. KMB reserves the right to create limit(s) on use at its sole and absolute discretion at any time without prior notice to User. |
| 3. | KMB reserves the right to make revisions, corrections, amendments and/or improvements to the Application or the contents thereto at any time without notice. KMB expressly disclaims all liability for loss and damage incurred directly or indirectly as a result of errors, omissions, discrepancies or system interruptions by User. |
| 4. | KMB shall in no event be liable for any direct, indirect, incidental, consequential, special or punitive loss or damage, loss of income or revenue, loss of profits or contracts, loss of business, loss of opportunity, loss of goodwill and/or reputation, loss of data or any other loss arising out of User’s access to, or use of, the Application (whether based on breach of contract, breach of warranty, indemnity, restitution, negligence, strict liability or other liabilities in tort, breach of confidence, misuse of private information, or otherwise) even if KMB is advised of the possibility of such losses or damages. |
| 5. | KMB makes no warranty as to the reliability, accuracy, timeliness, usefulness or completeness of the information on the Application. User’s access to or use of the Application does not create in any way any relationship that would give rise to any duty on the part of KMB apart from those provided for in the Terms, if any. |
| 6. | KMB does not guarantee uninterrupted, continued or secure access to the Application. Part or whole of the Application may be unexpectedly unavailable for whatever duration and for various reasons that may include system malfunctions and disruption, internet access downtime and other technical problems beyond KMB’s control for which KMB cannot and shall not be held responsible. KMB reserves the right to take any part or all of the Application offline for various reasons including but not limited to system maintenance or upgrading. |
| 7. | KMB makes no warranty to the accuracy or reliability of any information or content obtained through the Application, or that defects in software or hardware problems will be solved. |
| 8. | KMB expressly disclaims all liability for loss and damage incurred directly or indirectly as a result of errors, omissions, discrepancies or system interruptions by any User. Further, User agrees that he/she will not hold KMB responsible for any damage or losses caused by his/her inability to use the Application for any reason whatsoever. |
| 9. | Google Maps may be utilized, shown or referred to in the Application. Google LLC may however discontinue the provision of Google Maps on the Application at any time without prior notice to KMB. KMB disclaims all responsibilities for any loss and damage arising from such discontinuation. KMB does not have control over and shall in no event be able to guarantee the accuracy of Google Maps on the Application. In any event, KMB shall not be liable for any loss, claim or damage suffered by User whatsoever and howsoever arising or resulting from his/her use or inability to use Google Maps and its contents, including but not limited to negligence and disputes between any party. User shall indemnify KMB and keep KMB indemnified against all claims, actions, demands, losses or damage arising out of or resulting from his/her use of Google Maps and/or the Application or his/her infringement of any intellectual property rights. |
| 10. | KMB has no control over the linked website(s) or application(s) in the Application (if any) and is not responsible for the contents of any linked website(s) or application(s), or any links contained in such linked website(s) or application(s), or any changes or updates of such website(s) or application(s). KMB shall not be held responsible or liable for any loss or damage of any kind incurred as a result of the use of the services or the content of any linked website(s) or application(s). Any concern regarding linked website(s) or application(s) should be directed to the responsible site administrator(s) or operator(s). |
| 11. | Access and use of the Application is on a voluntary basis. User acknowledges and accepts that access and use of the Application is at his/her own risk. The contents, materials, goods and services provided by the Application are on an “as is” and “as available” basis without any warranty on satisfactory quality, merchantability, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. For the avoidance of doubt, the Application is not written to meet specific individual requirements. All representations, warranties and undertakings, whether express of implied, shall be expressly disclaimed. |
| 12. | User must not misuse or disrupt the Application by knowingly or negligently generating unnecessary traffic, introducing viruses, trojans, worms, logic bombs or other materials which may be malicious or technologically harmful to the Application. |
| 13. | User must not gain, or attempt to gain, unauthorized access to the Application or any of its related server(s), computer(s) or database(s). |
| 14. | User must not use the services of the Application for any purpose which may violate the law or regulation. User shall strictly comply with all laws and regulations in Hong Kong or elsewhere regarding online conduct and acceptable content. |
| 15. | User represents and warrants that he/she shall, when using the Application, not use the services of the Application for the purpose of spamming any other user and/or use the services of the Application for any purpose other than the service that the Application provided. |
| 16. | User shall maintain a courteous manner when using the Application. Any use of offensive language against the laws, e.g. discriminative in nature and/or threat, libelous or hate speech in the document submitted through the Application is strictly prohibited. |
| 17. | If a claim is brought and/or a complaint is lodged against KMB which is attributable to User’s acts done in or through the Application, User shall indemnify KMB and keep KMB fully and effectively indemnified from and against all damages, losses, and expenses of any kind (including all legal costs and fees) related to such claim to the maximum extent permitted by the law. |
| 18. | By using the Application, User consents to KMB’s collection and use of his/her personal data as described in the Privacy Policy Statement. When User browses any linked website(s) or application(s) through the Application, personal data may be collected. In such circumstance, such collection, use, process and transfer of personal data shall not be bound by the Privacy Policy Statement. User is reminded to review the privacy policy of such linked website(s) or application(s) in relation to the processing of personal data and be careful when disclosing personal data which may be collected and used by another party. Therefore, User must keep his/her personal data and password confidential. |
| 19. | All contents made available through the Application (the “Contents”) are the properties of KMB. KMB reserves all intellectual property rights on all text, graphics, photos and other contents of the Contents (or any part thereof). No modification, copying, redistribution, retransmission, publication, transfer, sale or any commercial exploitation of the Contents in whole or in part is permitted, no matter for the commercial purpose or otherwise. KMB reserves the right to claim damages and/or remedy of the aforesaid breach including but not limited to commencing legal action against User. |
| 20. | The rights attached to all registered or unregistered trademarks, trade names, registered or unregistered designs, logos, characters and service marks displayed in the Application (collectively the “Intellectual Properties”) shall be vested on KMB. KMB expressly claims all rights attached to the Intellectual Properties and shall in no event waive any claim of such rights. |
| 21. | KMB reserves the right to disallow User to link to or connect with the Application at any time. If KMB asserts such right, User shall remove forthwith such links to or connection with the Application. Further, the appearance and positioning of the links or connection shall in no event damage or affect the goodwill of KMB and shall in no event create or cause to create any impression that such entity has in any way connected with KMB. |
| 22. | The Terms shall be governed by and construed in accordance with the laws of Hong Kong. KMB and User agrees to submit to the non-exclusive jurisdiction of the courts of Hong Kong. |
| 23. | If there is any inconsistency between the English and Chinese versions of the Terms, the English version shall prevail. |
| 1. | 九龍巴士(一九三三)有限公司 (「九巴」) 可不時修訂及更新本服務條款 (「本條款」) 包括但不限於就OPS1933流動應用程式 (「本程式」) 的某些特點發出增補條款。每位本程式的用戶 (「用戶」) 已獲告知須定期經本程式檢視並熟知本條款的最新版本。九巴可於本程式內以通告形式，但並無責任，通知用戶任何更新。若於此等修訂及更新生效後仍繼續存取或使用本程式，用戶同意受修訂後的本條款所約束，而該修訂將取代所有以往九巴向用戶提供的條款。 |

| 4. | 九巴不會在任何情況下承擔任何直接、間接、附帶、相應、特殊或懲罰性損失或損害、收入或收益損失、利潤或合同損失、業務損失、機會損失、商譽及/或聲譽損失、資料損失或其他因用戶存取或使用本程式所造成的損失 (不論是基於違反合同、違反保證條款、彌償、復還、疏忽、嚴格法律責任或其他侵權法下的責任、洩漏機密、誤用私人資料或其他) 的責任，就算九巴已獲告知該等損失或損害的可能性。 |
| 5. | 九巴不對本程式內容的可信性、準確性、及時性、適用性及完整性作任何保證。用戶的存取或使用本程式並不會以任何形式產生任何關係而致使九巴方面承擔任何責任，而本條款所提供的責任 (如有) 則除外。 |
| 6. | 九巴不保證本程式能不間斷地、連續地或安全地存取。本程式的部分或全部可能於某時段內及因不同理由意外地不能存取，包括系統故障及中斷、互聯網存取故障及其他超出九巴控制範圍的技術問題，九巴不能亦不會被認為應對此負責。九巴保留權利因包括系統維護或更新在內的不同原因而將本程式或其任何部分離線。 |
| 7. | 九巴不保證經本程式所取得的任何資訊或內容的準確性及可信性，或任何軟件或硬體的問題能被解決。 |
| 8. | 九巴明確地拒絕承擔所有因任何用戶的錯誤、遺漏、差異或系統干擾而造成的直接或間接損失或損害的責任。而且，用戶同意他/她不會因任何理由令其不能使用本程式而導致的任何損失或損害要求九巴承擔責任。 |
| 9. | Google地圖可在本程式中被使用、顯示或引用。但Google公司可於任何時間及沒有預先通知九巴的情況下中止向本程式提供Google地圖。九巴拒絕承擔所有因該中止而起的任何損失或損害的責任。九巴不能控制亦不能保證於本程式中Google地圖的準確性。在任何情況下，九巴均不承擔用戶因使用或未能使用Google地圖及其內容而遭受的任何形式的損失、索償或損害，包括但不限於疏忽及任何一方提出的爭議。用戶須彌償九巴並使九巴得到彌償因他/她使用Google地圖及/或本程式或他/她違反任何知識產權而引起所有索償、訴訟、申索、損失及損害。 |
| 10. | 九巴對本程式中連結網站或應用程式 (如有) 並無控制權，亦不會對任何連結網站或應用程式的內容，或任何該等連結網站或應用程式所載的連結，或任何該等網站或應用程式的變更或更新承擔責任。九巴不會對使用任何連結網站或應用程式的內容或服務而導致的任何損失或損害承擔責任或負責。任何關於該等連結網站或應用程式的疑慮，應向負責的網站管理人或營運商提出。 |
| 11. | 本程式的存取和使用是自願性質的。用戶確認及接受存取和使用本程式須自行承擔風險。本程式的內容、資訊、產品及服務均是以「現狀」及「可用」的形式提供，且不會就讓人滿意的質素、可商售、對某特定用途的適用性、沒有侵犯任何權利、適用性、安全性及準確性提供任何保證。為免疑慮，本程式並不是為特定的個人要求而編寫。任何陳述、保證或承諾，無論明示或默示的，均被明確否認。 |
| 12. | 用戶絕不可在知情或疏忽的情況下產生不必要的流量、載入電腦病毒、木馬程式、電腦蠕蟲、邏輯炸彈或其他惡意或科技上對本程式有害的資料，以濫用或破壞本程式。 |
| 13. | 用戶絕不可對本程式或其任何相關伺服器、電腦或資料庫取得或嘗試取得未經許可的存取。 |
| 14. | 用戶絕不可將本程式的服務用於任何可能違法或違規的目的。用戶須嚴格遵守香港或其他地方有關在線行為和可接受內容的所有法律法規。 |
| 15. | 用戶陳述及保證他/她在使用本程式時，不會使用本程式的服務以達到向任何其他使用者發出大量未要求傳送的資訊的目的及/或使用本程式的服務以達到本程式提供的服務以外的任何目的。 |
| 16. | 用戶在使用本程式時應保持禮貌。嚴禁透過本程式提交文件時使用任何違反法例的冒犯性語言，例如具有歧視性質的及/或帶有威脅、誹謗或仇恨的言論。 |
| 17. | 若有因用戶於本程式上或經由本程式所作的行為而導致九巴被提出申索及/或投訴，用戶須就該申索相關的任何形式的損害、損失及支出 (包括所有律師費及其他支出) 對九巴作出法例容許的最大彌償。 |
| 18. | 用戶在使用本程式時同意九巴根據私隱政策聲明所訂收集和使用他/她的個人資料。當用戶瀏覽經本程式連結的任何網站或應用程式時，個人資料可能會被收集。在該等情況下，有關個人資料的收集、使用、處理及轉移將不受九巴的私隱政策聲明所約束。用戶已獲告知應查閱此等網站或應用程式對個人資料處理的私隱政策，並應謹慎向可能收集和使用其個人資料的第三方作出披露。因此，用戶須將他/她的個人資料及密碼保密。 |
| 19. | 所有本程式內可供使用的內容 (「該等內容」) 均為九巴的財產。九巴保留一切有關該等內容的文字、圖案及其他內容 (或其任何部份) 的知識產權。嚴禁就該等內容的全部或部份的更新、抄錄、分發、轉遞、刊登、轉移或出售、或任何商業使用，不論是否具備商業目的。九巴保留就上述違規行為要求賠償和/或補救的權利，包括但不限於對用戶提出法律訴訟。 |
| 20. | 於本程式內顯示的已註冊或未註冊商標、商用名稱、已註冊或未註冊的設計、標誌、人物角色及服務標記 (統稱「該等知識產權」) 均為九巴的知識產權。九巴明確地申明擁有該等知識產權的所有權利，並在任何情況下均不會放棄該等知識產權。 |
| 21. | 九巴保留權利於任何時間不允許用戶鏈接到或連接至本程式。若九巴行使該權利，用戶須即時刪除對本程式的鏈接或連接。而且，所有鏈接或連接的顯示及位置均不得對九巴的商譽造成損害或影響，亦不得造成該實體與九巴有任何關連的印象。 |
| 22. | 本條款按香港的法律管轄及詮釋。九巴及用戶均同意接受香港法院非排他性的司法管轄權。 |
| 23. | 若本條款的中英文版本存有任何歧義，概以英文版本為準。 |
